EU AI Act In Depth

NIST AI Risk Management Framework

The NIST AI Risk Management Framework (AI RMF 1.0, January 2023) provides a voluntary, flexible framework for managing risks throughout the AI lifecycle. Where the EU AI Act is prescriptive — it specifies what must be done — the NIST AI RMF is process-oriented: it specifies a way of thinking about AI risk that organisations can apply to their specific context. The framework's four core functions — Govern, Map, Measure, and Manage — provide a continuous risk management cycle that complements rather than duplicates regulatory compliance obligations. Many US organisations treat NIST AI RMF compliance as their primary AI governance framework and then map EU AI Act obligations onto it where they operate in the EU market.

Govern: Policies & Accountability

The Govern function establishes the organisational context for AI risk management — the policies, processes, roles, and culture that enable the other three functions to operate effectively. Govern is about accountability: who is responsible for AI risk management decisions, what authority do they have, and what oversight mechanisms exist? The AI RMF's Govern subcategories require organisations to establish an AI policy that articulates their approach to responsible AI; define roles and responsibilities for AI risk management (including executive accountability); integrate AI risk management into broader enterprise risk management; and build organisational AI literacy so that decision-makers understand the risks they are accepting.

The governance structures that work in practice share common characteristics: a clear designation of AI system ownership (someone is accountable for every production AI system), a governance committee with authority to approve or reject high-risk AI deployments, an escalation path for AI incidents, and a training programme that covers both technical staff (who need to understand the risk assessment process) and non-technical leaders (who need to understand the decisions they are being asked to approve). The common failure mode is governance-as-checklist — a process that generates documents without generating real accountability. Effective governance requires that the people who sign off on AI risk assessments actually read them, understand what they are approving, and have the authority and willingness to say "no" when the risk is too high.

Map, Measure & Manage

The Map function characterises the AI risk context: who is the intended user? who might be affected? what are the intended and possible unintended uses? what are the potential harms — to individuals, to groups, to society? what data does the system use and where does it come from? Mapping is primarily a qualitative exercise that draws on domain knowledge, stakeholder input, and structured risk identification techniques. The output of the Map function is a risk context that informs the prioritisation and measurement strategy for the next function.

The Measure function evaluates AI risks quantitatively and qualitatively. This is where bias auditing (Part 23), red teaming (Part 23), performance benchmarking, robustness testing, and fairness metric computation happen. Measure requires defining what "trustworthy" means for the specific AI system — and that definition will differ substantially between a medical diagnosis AI (where false negatives are life-threatening), a content recommendation AI (where the primary concerns are engagement vs. harm trade-offs), and a fraud detection AI (where both precision and recall matter but in domain-specific ways). The Manage function implements risk responses: accepting, avoiding, mitigating, or transferring risks based on the Map and Measure outputs. Audit logging for AI decisions is a regulatory requirement under EU AI Act Article 12 (for high-risk AI systems), a core component of NIST AI RMF's Manage function, and a prerequisite for meaningful incident investigation and accountability. The challenge in AI audit logging is different from traditional software logging: you must capture enough information to reconstruct the decision context (which inputs led to which output?), while respecting privacy (you should not log raw personal data that you could not otherwise justify retaining) and maintaining system performance (logging every prediction in high-throughput systems must be done efficiently). The design pattern that resolves this tension is hashing: log a hash of the input (which allows you to match the log to the original input if you still have it, or verify that a specific input led to a specific output) rather than the raw input itself.

The regulatory requirement is not just to log, but to be able to produce an audit report from the log within a reasonable time. EU AI Act Article 12 requires high-risk AI systems to maintain logs that enable traceability "for a period appropriate to the intended purpose of the high-risk AI system." The questions that will define the next decade of AI practice are simultaneously technical, organisational, and political: How do we ensure that frontier AI models remain aligned with human values as their capabilities grow? Frontier Model Risks & Safety

The AI safety research community has identified a set of risks specific to large, capable AI models that do not arise at smaller scales — emergent capabilities (behaviours that appear suddenly at certain scale thresholds and cannot be predicted from smaller model performance), deceptive alignment (models that appear aligned during training but behave differently when deployed), and the difficulty of specifying human values precisely enough to serve as a training signal. These are genuine technical challenges, not speculative science fiction: emergent capabilities have been empirically documented (the ability to perform multi-step arithmetic, follow complex instructions, and reason about theory of mind all emerge at specific scale thresholds in large language models), and alignment failures have been demonstrated in lab settings.

The organisational response to these risks is the AI safety research and evaluation ecosystem: safety teams within frontier model labs (Anthropic's safety research, OpenAI's alignment team, Google DeepMind's safety research), external evaluation organisations (the UK AI Safety Institute, the US AI Safety Institute at NIST), red team programmes that specifically probe for dangerous capabilities before model releases, and structured capability evaluations that test for behaviours like CBRN (chemical, biological, radiological, nuclear) uplift potential and autonomous replication capability. Geopolitics of AI

AI has become a domain of great-power competition in a way that has few historical precedents in dual-use technology. The US-China competition in AI is simultaneously a competition over frontier model capabilities (which country's companies develop the most capable models first), semiconductor access (which country's manufacturers can produce the most advanced AI chips), and standards leadership (which country's governance frameworks become the global baseline). US export controls on advanced AI chips (October 2022, expanded October 2023, further tightened in 2024) represent a deliberate attempt to constrain China's ability to develop frontier AI capabilities — a significant escalation from previous technology competition dynamics. China has responded by accelerating domestic chip development (Huawei's Ascend series, SMIC's advanced node ambitions) and investing heavily in AI research with open-weight models (DeepSeek, Qwen) that can be downloaded and run on hardware not subject to export controls.

For AI practitioners, the geopolitical dimension creates concrete operational consequences: questions about which cloud infrastructure to use (are US-developed cloud services available in your target markets?), which models to deploy (can you use certain frontier models in certain jurisdictions?), and how to structure supply chains for AI-powered products (which countries' hardware is in your inference stack?) all now have geopolitical dimensions that they did not have five years ago. The fragmentation of the global AI ecosystem — into a US-aligned cluster, a China-aligned cluster, and potentially other regional poles — is a genuine possibility with significant implications for practitioners building global products.

AGI on the Horizon

Artificial General Intelligence — a system capable of performing any intellectual task that a human can perform — is simultaneously closer and more uncertain than at any previous point in the history of AI. Leading researchers and laboratory leaders give median estimates for human-level AI performance on a broad range of tasks that range from 3 years to 30 years, with a roughly bimodal distribution: a significant fraction of the field believes transformative AI is near-term (this decade), while another significant fraction believes current scaling will plateau before reaching general human-level capability. The honest answer is that we do not have a reliable theory of when or whether current architectures will reach AGI — the scaling laws that have successfully predicted capability improvements at existing scales may break down, or they may not. This uncertainty is itself a reason for building robust governance structures now: institutions and processes for governing powerful AI systems take years to develop, and waiting until the technology has arrived to build them is too late.

Twenty-four articles ago, this series began with a simple premise: that AI in the real world is far more interesting, more complex, and more consequential than any abstracted account of the technology can capture. That premise has held up across the full breadth of the curriculum — from the mathematical foundations of supervised learning through the engineering of frontier model infrastructure, from the excitement of generative AI applications through the hard-won lessons of bias auditing and red teaming, from the promise of AI in healthcare and finance through the sobering challenges of alignment research and global AI governance.

The most important lesson, if there is one, is about the relationship between technical competence and ethical responsibility. They are not in tension — they are mutually reinforcing. The engineer who understands GPU memory hierarchies deeply also understands why training a billion-parameter model has a carbon cost that deserves to be weighed against its expected value. The practitioner who can implement FlashAttention also understands why the same attention mechanism, applied to surveillance data at scale, creates risks that no amount of technical elegance can justify. The practitioners who will navigate this landscape most effectively are those who continue to learn, who combine technical rigour with policy awareness and ethical reasoning, and who treat responsible AI not as a constraint but as an engineering discipline in its own right.
